Article 3. The matters to be described in the business plan as specified in the Ordinances of the Ministry of Transport under the provisions of Article 25 paragraph 3 (Matters to be Described in Business Plan) of the Law shall be as listed below:
(1)Date of the commencement of business as listed in each subparagraph of Article 44 paragraph 1 (Business of Organization);
(2)Outline of planning concerning the business listed in each subparagraph of Article 44 paragraph 1 of the Law;
(3)Method of procurement of capital and its utilization;
(4)Formation of the Organization;
(5)Other necessary matters.
(Application for Approval of Establishment)
Article 4. Any person who intends to obtain approval under the provisions of Article 26 (Approval of Establishment, etc.) of the Law shall submit to the Minister of Transport an application describing the following matters, accompanied by the articles of association and the business plan:
(1)Name, address and history of promoter;
(2)Date on which Organization to be established;
(3)Name of Organization to be established;
(4)Name, address and employment history of the person to be Chairman of the Board of Directors, and the Auditor recommended by the promoter;
(5)Outline of progress up to the application for approval of establishment is submitted.
(Approval and Application for Alteration of Articles of Association)
Article 5. The Organization shall, when it intends to obtain approval under the provisions of Article 31 paragraph 2 (Approval for Alteration of Articles of Association) submit to the Minster of Transport an application describing the following matters:
(1)Matters which it intends to alter;
(2)Reason(s) necessitating the alteration.
(Application for Approval of Appointment of Directors)
Article 6. The Chairman of the Board of Directors shall, when intending to obtain approval under the provisions of Article 34 paragraph 2 (Approval for Appointment of Chairman of Board of Directors) of the Law, submit to the Minister of Transport an application describing the names, addresses and personal histories of the persons to be appointed as the Directors.
